Statutory Registrations

Every organisation, functioning in India, is mandated to comply with various rules and regulations of the land. The Government of India has formed various statutory bodies and ministries who overlook the management and implementation of such laws. Therefore, every business needs to obtain independent registrations under such bodies and report to them.

EPFO Registration: Employees’ Provident Fund Organisation (EPFO) is an independent body under the control of Ministry of Labour and Employment, Government of India. All the organisations employing more than 20 employees fall liable under the Employees Provident Fund Act, 1952 to obtain registration as an employer with this body and contribute towards the Provident Fund of their employees. The monthly contribution towards the PF amounts to 12% of the basic salary and dearness allowance of the employee.

ESI Registration: This registration is required under Employee State Insurance Act, 1948 by every factory establishment having more than 10 employees (20 in some states) and workers. An autonomous body called Employee State Insurance Corporation (ESIC) has been set up to overlook the same under the Ministry of Labour and Employment. This act was enacted to provide for certain benefits to employees in case of any sickness or injury during the employment.

Permanent Account Number (PAN): Every taxpayer needs to register himself with the Income Tax Authorities and obtain a unique PAN number. PAN number is a 10-digit code assigned to every independent taxpayer and is used for all future compliances and communications by the Tax Department in India. Even foreign entities and Non- Resident Indians who have some sort of income in India or want to claim credit for tax deductions at source need to obtain this PAN. Obtaining PAN is a complete online process and requires careful considerations of all the legal documents to be submitted with the Authority.

Tax Deduction Account Number (TAN): TAN is a 10-digit alpha numeric code assigned by Income Tax Department of India to every person who is liable to deduct/ collect tax at source (TDS/ TCS). Every taxpayer who is an Individual or HUF and is required to undergo tax audit under Section 44AB of the Income Tax Act, 1961 is liable to deduct TDS. Apart from this, all the company form of entities fall, compulsorily, under the TDS provisions. This number is linked to the PAN number of the entity and the registration process is completely online.
